Welcome to Secrets Metaverse. These Terms of Service ("Terms") govern your access to and use of the Secrets Metaverse game, launcher, website, and related services (collectively, the "Services") operated by Secrets Metaverse ("we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Eligibility

You must be at least 18 years old to use Secrets Metaverse. By creating an account or using our Services, you represent and warrant that:

• Your use complies with all applicable laws in your jurisdiction

2. Account Registration

• Cheat or exploit bugs, glitches, or vulnerabilities
• Use unauthorized software including hacks, bots, or automation tools
• Attempt to access other users' accounts or private information
• Interfere with or disrupt the Services or servers
• Reverse engineer or decompile any part of the Services
• Sell or transfer your account to another person
• Engage in real-money trading of in-game items outside official channels

4. Virtual Currency and Purchases

4.1 Diamonds

Diamonds are virtual currency used within Secrets Metaverse. Diamonds:

• Have no real-world monetary value
• Cannot be exchanged for real currency
• Are non-transferable between accounts
• May be forfeited if your account is terminated for violations

4.2 Cryptocurrency Purchases

You may purchase Diamonds using SECH cryptocurrency. By making such purchases, you acknowledge:

• All cryptocurrency transactions are final and non-refundable
• Transactions are recorded on the public Arbitrum blockchain
• You are responsible for ensuring correct wallet addresses and amounts
• We are not responsible for transactions sent to incorrect addresses
• Price and availability of Diamond packs may change at any time

4.3 No Refunds

All purchases of Diamonds and virtual items are final. We do not offer refunds except where required by applicable law.

5. Intellectual Property

5.1 Our Content

All content in the Services, including but not limited to graphics, logos, text, software, audio, and video, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

5.2 User Content

You retain ownership of content you create (such as avatar configurations). By using the Services, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the Services.

6. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Termination

7.1 By You

You may terminate your account at any time by contacting us. Upon termination, you will lose access to your account and any associated virtual items or currency.

7.2 By Us

We may suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Conduct that we determine is harmful to other users or the Services
• Suspected fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Any other reason at our sole discretion

7.3 Effect of Termination

Upon termination, your right to use the Services immediately ceases. Any Diamonds or virtual items in your account will be forfeited. We are not obligated to provide refunds upon termination.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• UNINTERRUPTED OR ERROR-FREE SERVICE

We do not guarantee that the Services will be secure, error-free, or available at all times.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Cost of substitute services
• Any damages arising from your use or inability to use the Services

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Secrets Metaverse and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your user content

11. Modifications to Services

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We may also modify virtual items, their availability, or their pricing. We are not liable for any modification, suspension, or discontinuation of the Services.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and changing the "Last Updated" date. Your continued use of the Services after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration, except where prohibited by law.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Secrets Metaverse regarding the Services and supersede any prior agreements.
